The “Terms and Conditions” of Dev Services is a legal contract between the client (either an individual or an entity that is representing, hereinafter “you”) and Dev Services for the services. By signing up or otherwise using Dev Services, you are entering into a binding contract with us. It acknowledges that Dev Services would not agree to provide the services without that assent.

CANCELLATION AND TERMINATION

All rights are reserved to Dev Services to refuse service for any reason, at any point of time to anyone.

Any use of service/software which is illegal may result in termination of your contract and may lead to cancellation of your account.

You are solely responsible for properly canceling/deactivating your account.

Dev Services, in its sole discretion has the right to suspend or terminate your account and refuse any or all current or future use of the services. It could be accounted for any reasons, like unauthorized access of our portal, servers and databases, abusive behavior, data theft, improper utilization of our services, using the service for PC, or website/project other than the one which has been registered for use with Dev Services, among other reasons. Such termination of the service/contract will result in the deactivation or deletion of your account.

SERVICES/PLANS

Your services refer to your contract with Dev Services under the plan that you enrolled with. Dev Services offers multiple service plans, which entitles you to access our support agents 24/7 for the duration of the contract. In this duration of your service plan, you can call our expert any time for software related issues with your computers/peripherals included in the service plan.

Dev Services reserves the rights to modify , discontinue- temporarily or permanently service (or any part thereof) with or without notice at any time.

PAYMENTS/CREDIT CARD BILLING

In process of signup with Dev Services, you may be asked for credit card number from a card issuer that we accept in order to activate your service. You hereby authorize Dev Services to charge and/or place a hold on your credit card with respect to any unpaid charges for Services.

You authorize the issuer of the credit card to pay any amounts described herein without requiring a signed receipt. In addition to it, you agree that these charges are to be accepted as authorization to the issuer of the credit card to pay any amounts described herein without requiring a signed receipt. It certifies that you agree that these charges are to be accepted as authorization to the issuer of the credit card to pay all such amounts.

You authorize Dev Services and/or any other company who bills products or services, or acts as billing agent for Dev Services to continue to attempt to charge and/or place holds with respect to all sums described herein, or any portion thereof, to your credit card until such amounts are paid in full.

You acknowledge and agree that neither Dev Services nor any Dev Services affiliated company will have any liability whatsoever for any non-sufficient funds or other charges incurred by you as a result of such attempts to charge, and/or place holds on, your credit card.

If you mistakenly provide a debit card number, instead of a credit card number, you authorize all charges described herein to be applied to such debit card unless and until you provide a credit card number.

In the event you are enrolled, or later enroll, in an automatic payment or electronic funds transfer plan, you agree that all sums described herein may be charged, at Dev Services option, to the account number provided for such automatic payment or electronic funds transfer plan. When payment is made by credit card or debit card, payment will also be subject to the terms and conditions established by the credit or debit card issuer. If charges cannot be processed through your credit card, or if your bank draft or electronic funds transfer is returned for insufficient funds, we will charge you an additional $20.00.

GENERAL TERMS

Currently the service is available only in English language.

Verbal, written or other abuse (including threats of abuse or retribution) by any Dev Services  customer to any Dev Services  employee, member, or officer will result in immediate contract termination.

You must not modify, or resell our services to a third-party unless explicitly specified by us. Any liability that arises from this would be solely yours.

ACCEPTANCE OF AGREEMENT

Dev Services  provides access for online services to its clients, which may require them to acknowledge and accept terms of agreement. It can be done by clicking “I Agree” or “I Accept” or “Submit” anywhere on a Dev Services website. By doing this:

It will be treated as your consent to perform the task that you have clicked on, thus entering into acceptance of agreement.

You have read and understand the contract, notices and records, including, without limitation, this agreement, and any policies and any amendments hereto or thereto

ALTERNATIVE DISPUTE RESOLUTION: MEDIATION AND ARBITRATION

The parties to this contract agrees to negotiate in with good faith and put an effort to resolve any dispute arising from or related to this contract.  If the dispute cannot be resolved by informal negotiation, the parties agree to submit any disputes relating to this contract to mediation.  If any disputes cannot be resolved through meditation, the parties agree to submit any disputes relating to this contract to binding arbitration.  For both mediation and/or arbitration, the parties shall work together to pick a mutually agreeable mediator and/or arbitrator.  If a mutually agreeable mediator and/or arbitrator is not chosen, each party shall pick a mediator and/or arbitrator and those two professionals shall pick a third mediator.

UNLAWFUL ACTIVITY

Dev Services reserves all right to investigate complaints or reported violations of this contract. If needed to Dev Services have right to take any action we adjudge appropriate, including but not limited to reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties. It may lead to disclosing any information necessary to persons or entities relating to your profile, email addresses, usage history, posted materials, IP addresses and traffic information.

Notices: All Notices to the parties shall be in writing and shall be deemed duly served on the date personally served or sent via certified mail, return receipt requested, to the parties at the email addresses : info@devservices.co
